Malaysian Bar demands....

Motion

Whereas on the night of 7 May 2009, five members of the Kuala Lumpur Legal Aid Centre, Fadiah Nadwa binti Fikri (Secretary), Murnie Hidayah binti Anuar, Puspawati binti Rosman, Ravinder Singh Dhalliwal (Chairperson) and Syuhaini binti Safwan (collectively known as the “LAC Lawyers”), in their capacity as Advocates & Solicitors, had requested the police at the Brickfields Police Station for access to the detained persons who were arrested that same night whilst holding a candlelight vigil at the same Police Station over the recent arrest of political scientist Wong Chin Huat.

Whereas Article 5(3) of the Federal Constitution entrenches the fundamental right of a person to consult and be defended by the legal practitioner of his/her choice. Further, sub-sections 28A(2) to (7) of the Criminal Procedure Code (“CPC”) set out in detail the rights of arrested persons including their right to communicate and consult with a legal practitioner of their choice.

Whereas the Police denied the LAC Lawyers access to the detained persons, the Police, without any reasonable grounds, proceeded to arrest the LAC Lawyers and only released them on police bail the following day at around 3 p.m., notwithstanding the repeated requests by other lawyers for their immediate release.

NOW IT IS HEREBY RESOLVED THAT THE MALAYSIAN BAR:

1. Strongly condemns and denounces the wrongful arrest, detention and interrogation of the LAC Lawyers.

2. Strongly condemns and denounces the blatant transgression of the rule of law and the constitutional right of every person to counsel and access to justice.

3. Strongly condemns the unnecessary arrest and detention of those exercising their constitutional right to assemble peaceably.

4. Strongly condemns the arbitrary, improper and frequent resort by the Police to section 28A(8) of the Criminal Procedure Code, thus denying an arrested person access to counsel and making the right provided under section 28A(3) meaningless.

5. Strongly condemns and denounces the appalling treatment of the LAC lawyers and all those held in custody, including compelling them to wear lock up uniforms and unnecessarily handcuffing them.

6. Strongly condemns and denounces the Police for deliberately refusing to disclose to their family or their lawyers any information in relation to the LAC lawyers after their arrest, including their location and their next course of action.

7. Demands the resignation of the Minister for Home Affairs, the Inspector-General of Police, OCPD ACP Wan Abdul Bari bin Wan Abdul Khalid and DSP Jude Pereira of the Brickfields police station over this shameful incident.

8. Condemns the gross abuse of police powers and demands that the Government offer an unconditional apology to the LAC Lawyers.

9. Demands that the Government commit to and uphold the Rule of Law as enshrined in the Federal Constitution.

10. Reiterates its previous calls on the Government to establish the Independent Police Complaints and Misconduct Commission (IPCMC) in its original form to serve as an independent external oversight mechanism.

11. Demands that the Government uphold and defend the fundamental rights of advocates and solicitors to discharge their responsibilities to their clients in an environment free from threats and intimidation and unhindered by law enforcement agencies.

Now they are resorting to Molotov Cocktail on YB Teresa. Thankfully nobody is hurt.

I cannot understand what wrong she did.

The mosque committee already lodge a police report saying she was never involved. And now some idiots use such things on her.

Why is this HAPPENING AGAIN?

We finished our pre ceramah at about 11.30pm at the DAP's Dewan Rakyat. Goh Leong San (DAP Chairman), Koh Sze Choon (former candidate of Klebang and YBB - Yang Bakal Berhormat) and I were at the lounge of DAP office relaxing and joking away.

Suddenly, we were interrupted by Gandhi (Taman Merdeka Branch member) together with about 4 Indian friends who complained to us that their tents were burned down by some jokers at about that time. The place was located in Cheng, Melaka some 15km away from DAP office in Taman Pandan. The tents were erected on the side of the road for preparation of the annual Hindu festival. It will be used to shade devotees and at the same time for food preparation.

Personally I was utterly shock by such irresponsible act of uncivilised group of people. Such act should not be condoned as heroic. I must say that the police must act fast before it turn to be unruly as Malaysia cannot afford to have a racial clash.

I NOW call upon the police to act swiftly and investigate this notorious act of contempt. It must be done without any fear and favour by the police and also to make the necessary arrest of those that are involved with such despicable act of terror.

Such act is nothing short of a work of terror intending to incite hatred amongst Malaysian.

Enough is enough, let us cry for CHANGE.

Propaganda vs Truth

This is what Malaysian political propaganda declares in our government newspaper :

Waytha Moorthy, has conceded that the cause of the unregistered organisation is as good as lost. ...In a sharp and surprise twist of events, Waytha Moorthy, who is chairman of Hindraf, said in an interview published in today's Deccan Chronicle, the highest-selling English language newspaper in Hyderabad in the southern Indian state of Andra Pradesh, that the movement had to close its chapter.

..."There may be a new chapter, but we may not be part of the next chapter. I know eventually we would fail," he was quoted as saying in today's edition of the newspaper.

...Conceding that Hindraf was fighting a "losing battle", Waytha Moorthy said the struggle of the organisation was likely to die soon.

"We are fighting a losing battle, we know. We tried our level best but if we don't succeed we have to call it a day, isn't it ?" he told the newspaper."

The actual story from International Herald Tribune which our political propaganda purposefully blanked this out....

"We want the minority Indians to be given their basic rights If they can give us two or three (real concessions), we are willing to keep our mouth shut," Moorthy said.

"That's what I don't understand: why isn't the government conceding? We are not asking for super rights, we are asking for basic rights."

Double standard?????? OF COURSE, without a doubt.
Why don't arrest him too since there is no limitation period for a criminal wrong

What wrong did Edmund committed?

Something is so wrong with the authorities. Something is so wrong with DBKL and the POLICE. Between Khairy and Bon, Khairy did a CRIMINAL ACT whereas Bon did nothing WRONG....

I urged the authorities to arrest Khairy for illegal demonstration....

It's confirmed MALAYSIA is a POLICE STATE

I'm utterly disgusted and embarrassed by the unilateral and arbitrary abuse of police power in arresting my friend, Mr Edmund Bon, Chairman of the Human Rights Committee of the Bar Council. He was arrested in a mafia-style Hollywood type by the police. I, together with all right minded Malaysian, am ashamed of this abuse of police powers. It was a total disregard of the constitutions, and any laws of this country. What Bon did was explaining to DBKL officers that the banners were in private property and subsequently a senior police personnel arrested him. This is definitely a coward act by the powers that be.

As a concerned citizen, right minded Malaysian and a fellow member of the Bar, I call upon the immediate release of E. Bon and all members that were arrested together.

I now call upon the resignation of the Inspector General of Police for his failure to uphold the constitution and protecting the innocence.

I further call the resignation of the the Internal Security Minister and the Home Affair Minister for their failure to uphold the constitution and carry out the duties of their high offices.

Hindraf = Terrorist?

“As we know, the LTTE has been declared a terrorist group by the United Nations and the United States...." per Nazri the 'damn-smart-he-thinks' so-called minister of law. Or rather minister without portfolio. What a damn position. Some says that he is a minister of parliament's table and chair. ToiletLAH.....

So he says that. Suddenly we follow the US which our garmen had in almost every occasion condemned. Now our garmen declare them as a terrorist group just because Hindraf hantam the garmen. Sometimes I just don't understand the definition of 'terrorist'. Does Hindraf asking their members to take arms against the government? As far as I know and have read, I don't think Mr. Utayakumar is damn stupid to take arms against the government. I know sometimes that he can be a pain in the toot and emotional or maybe passionate with the things he does BUT to be part of a terrorist link, that is so absurd.

I seriously taktau how Tan Sri Musa (IGP) got his information from. Maybe just acah acah, diverting the very intention of Hindraf and wanting to let the whole country to be mad with Hindraf

Not all BN people are IDIOTS

KUALA LUMPUR (Dec 5, 2007): The government should manage demonstrations properly and not use force, as this will not help to solve the real problems at hand, said Datuk Zaid Ibrahim.

Zaid, the Barisan Nasional member of Parliament for Kota Baru, said he expected ethnic and religious issues to be among the serious issues to be discussed in the next general election.

He said that among them would be the issues raised by the Hindu Rights Action Force (Hindraf) demonstration in Kuala Lumpur on Nov 25.

He said this in his talk on the issues to be expected in the next polls, presented in the Rotary Club’s weekly meeting today.

Zaid observed that peaceful demonstrations were part of the democratic process.

"It is actually a small thing to me and I wish that after 50 years of independence, we will be able to manage this thing quite easily. To demonstrate and protest in a peaceful way is part and parcel of a democratic country," he said.

He added that the police could have told the people which road to take and how the organiser should control and limit the crowd so that the demonstration can be properly managed.

"But our response has always been 'No', even the Bar Council has abandoned the walk to celebrate International Human Rights Day (Monday, Dec 10).

"I was part of the walk last year and the year before. It was just a walk. We were just walking around the Lake Garden and it was good exercise," he said.

Zaid also said sensitive issues such as the demolition of temples must be handled with care, and overlooking that would risk provoking extreme reactions from the people who were affected by it.

He said "using force and power", the Internal Security Act or revoking the protesters’ citizenship would not help the situation or address the real issues faced by the people.

"We have to remember that we are a multi-cultural and multi-racial country and if we, all the time, see it as a Malay, Chinese or Indian issue, we are not going to see the real problem.

"Somebody said the Malays are worse than the Indians as only 2.9% of the Indians are poor, compared with 8% of the Malays who are poor. It is not going to help to say who has the problems. So why are we are still responding to the issues in such a negative way, why do we need to remind ourselves and start comparing ourselves as Chinese, Indians and Malays?" he asked.

"Let's not talk about race and religion. Let's just see things as what they are, economic issues and the sensitivity of the people."

Zaid said the nation needed a people-oriented government, which he described as one which would listen to even the most ridiculous demand from the people.

"Some even said we need new faces in the cabinet and I think so too," he added.

He said he was often asked why he joined the BN, and his reply was that the BN concept to get all the people together was a wonderful concept although it was not easy to achieve.

"You have a wonderful model and you just need to think, to adjust and change from within. So I criticise the BN because I want it to become better," he said, adding that the BN should be driven more as a coalition and not by one party or Umno.
